Terms of Service

These terms ("Terms") govern your use of PCBWay Studio MCP ("the
service"), an AI-assisted PCB design Model Context Protocol server
operated by Manuel Pérez ("we", "us", "the operator"). By connecting
the service from a Claude, ChatGPT, IDE plugin, or any other MCP client
you agree to these Terms. If you do not agree, do not use the service.

1. Description of the service

The service is a Model Context Protocol (MCP) server that exposes tools
and resources for:

Generating, validating, and reviewing KiCad PCB designs.
Searching and matching electronic components from Mouser, DigiKey, and

the JLCPCB catalogue.

Requesting fabrication and assembly quotes from PCBWay (and, where

available, JLCPCB and Eurocircuits).

Placing PCB and PCBA orders with PCBWay through their official API.
Tracking order status, generating invoices, and storing project

artifacts.

The service does not itself manufacture PCBs. Manufacturing is
performed by the third party you select (PCBWay by default), governed by
that party's separate terms and contract with you.

2. Eligibility

You must be at least 16 years old to use the service. By using the
service you represent that you have the legal capacity to enter into
these Terms in your jurisdiction.

If you are using the service on behalf of an organisation, you represent
that you have authority to bind that organisation to these Terms.

3. Account and authentication

When you connect the service from a marketplace client (Claude, ChatGPT,
etc.) you authenticate via OAuth 2.1. The service stores:

The OAuth subject identifier returned by your client.
A PCBWay API key that you provide on the /account page. This key

is encrypted at rest and used only to make calls to PCBWay on your behalf.

Optionally, an email address if you opt in to order notifications.

You are responsible for keeping your account credentials secure and for
all activity carried out under your account. Notify us at
<[email protected]> as soon as you suspect unauthorised use.

4. Acceptable use

You agree to use the service only for lawful purposes. You will not:

Use the service to design or manufacture devices intended for illegal

use, weapons systems, surveillance gear targeted at private individuals, or any product whose sale or possession is restricted in the buyer's or shipper's jurisdiction.

Submit designs that infringe a third party's intellectual property.
Attempt to probe, scan, or breach the service's security controls,

except as part of a coordinated disclosure (see §10).

Use the service to flood third-party APIs (Mouser, DigiKey, PCBWay,

GitHub) beyond their published rate limits, or to circumvent any abuse-prevention measures we put in place.

Resell, sublicense, or repackage the service without prior written

agreement.

Submit content that is defamatory, harassing, or violates someone

else's privacy.

Use the service in any way that disrupts other users' access.

We may rate-limit, suspend, or terminate your access if you violate
this section, with or without prior notice depending on severity.

5. Third-party services and your data

When you invoke a tool that calls a third party (PCBWay, Mouser,
DigiKey, JLCPCB, Resend, GitHub), the relevant payload — your design
files, BOM, contact details, etc. — is transmitted to that third party
under their own terms and privacy policies. We are not responsible for
how those parties process your data, and you are responsible for
reviewing their terms before invoking the tool.

A list of subprocessors and the data shared with each is in
PRIVACY.md §2.

6. Fees, commission, and pricing

6.1 Service fees

The service itself is currently provided free of charge to end users.
We reserve the right to introduce paid plans in the future, in which case
existing users will be notified at least 30 days in advance via the
/account page and (if you have opted in) email.

6.2 PCBWay commission disclosure

Full transparency: when you place a PCB or PCBA order through the
service using the place_order or place_pcba_order tool, the operator
receives a commission from PCBWay. The current commission rate is
8% of the order's gross value, capped by a per-month floor that does
not affect the price you pay.

This commission:

Does not add anything to the price PCBWay charges you. You pay

exactly the same as if you had ordered directly through PCBWay's website with no MCP service in between.

Is paid by PCBWay to the operator under a separate partnership

agreement.

Is recorded transparently in commission-ledger (admin only). The

operator can also generate a monthly attribution report.

Funds the development, hosting, and ongoing maintenance of the

service.

If you do not want the operator to receive a commission for your order,
you can place the order directly on PCBWay's website without using the
service.

6.3 Third-party fees

You are solely responsible for all fees charged by third parties:

PCBWay (manufacturing, shipping, customs, taxes)
Component distributors (Mouser, DigiKey)
Optional services (Resend email if you self-host, GitHub if you use

the GitHub App integration)

We are not party to those transactions and do not process payments for
them.

7. Intellectual property

7.1 Your content

You retain all ownership of designs, BOMs, prompts, and any other
content you submit to the service. By submitting content you grant us a
limited, non-exclusive, royalty-free license solely to:

Process the content to deliver the tool you invoked.
Forward the content to the third parties identified in PRIVACY.md

§2 only when you explicitly invoke a tool that requires it.

Store the content as described in PRIVACY.md §4.

We do not use your content to train any model. We do not use your
content for any purpose other than delivering the service you requested.

7.2 Service IP

The service code is licensed under MIT (LICENSE). The brand name
"PCBWay Studio MCP", the operator logo, and the visual design of the
official deployment are not included in the MIT license — those are
property of the operator and (where applicable) PCBWay, used with
permission.

7.3 Templates and shared designs

If you publish a template via publish_validated_design or
share_design, you grant other users of the service a non-exclusive,
royalty-free license to use, modify, and build upon that template for
their own designs. You can revoke a published template at any time via
forget_* tools or by emailing support, but already-downloaded copies
in third-party hands cannot be recalled.

8. Disclaimers and limitation of liability

8.1 No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF
ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NON-INFRINGEMENT.

The service uses LLMs and heuristic validators to assist with PCB
design. It is not a substitute for review by a qualified electrical
engineer. We make no guarantee that designs produced or validated by
the service will function correctly, comply with regulations (FCC, CE,
RoHS, REACH, UL, etc.), or be safe for any particular use. You are
responsible for verifying every design before manufacturing,
deploying, or distributing it.

The Peer Review Engine reports a confidence score and a production gate
verdict (APPROVE / REVIEW / BLOCK). These are heuristic indicators, not
certifications. A high confidence score does not relieve you of the
responsibility to perform your own review.

8.2 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE
OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,
OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER
INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR
OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of, or inability to access or use, the service.
Any conduct or content of any third party on the service, including

PCBWay, Mouser, DigiKey, JLCPCB, Eurocircuits, GitHub, or Resend.

Any unauthorised access, use, or alteration of your transmissions or

content.

Any defect in or failure of a manufactured PCB.

The operator's aggregate liability for any claims arising out of or
related to the service shall not exceed the greater of (a) EUR 100
or (b) the total amount you have paid the operator (not the third
parties) in the twelve months before the claim arose. As of the date
above, the service is free of charge, so this cap is EUR 100.

Some jurisdictions do not allow the exclusion of implied warranties or
the limitation of liability for consequential damages, so the above
limitations may not apply to you in part.

9. Indemnification

You agree to indemnify and hold harmless the operator from and against
any claims, damages, losses, liabilities, costs, and expenses (including
reasonable attorneys' fees) arising out of or in any way connected with:

Your use of the service in violation of these Terms.
Your designs infringing a third party's intellectual property.
Your designs causing physical, environmental, or financial damage

after manufacture.

Your violation of any applicable law or regulation.

10. Security and coordinated disclosure

If you discover a security vulnerability, please report it privately to
<[email protected]> with subject [SECURITY]. We will:

Acknowledge receipt within 72 hours.
Work with you on a remediation timeline (typically 30 days for

high-severity, 90 for medium, longer for low).

Credit you in CHANGELOG.md and the public security disclosure if

you wish.

Do not publish details of an unpatched vulnerability before we have
had a chance to fix it. We follow a 90-day responsible disclosure
window and will publish a coordinated advisory at the end of it.

11. Termination

You may stop using the service at any time. To delete your account and
all associated data, use the Delete account button on the
/account page or email <[email protected]>.

We may suspend or terminate your access immediately, without prior
notice, if:

You materially breach these Terms.
You use the service for fraudulent or unlawful purposes.
We are required to do so by law or by a third-party order.
The service is being shut down (we will give 30 days' notice via the

/account page in that case).

Sections 6.2 (commission disclosure history), 7 (IP), 8 (disclaimers),
9 (indemnification), and 12 (governing law) survive termination.

12. Governing law and disputes

These Terms are governed by the laws of Spain, without regard to
conflict-of-laws rules. Any dispute arising out of or related to these
Terms or the service shall be subject to the exclusive jurisdiction of
the courts of Madrid, Spain, except where mandatory consumer
protection law in your country of residence provides otherwise.

If you are a consumer in the EU, you may also use the European
Commission's online dispute resolution platform at
<https://ec.europa.eu/consumers/odr>.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we bump the
date at the top and record the change in CHANGELOG.md. Material
changes (new commission rates, new fee structures, expanded operator
liability allocation) are announced at least 30 days in advance via the
/account page and (if you have opted in) email.

Your continued use of the service after a material change becomes
effective constitutes your acceptance of the updated Terms. If you do
not agree with the changes, you must stop using the service before they
take effect.
